2. Motion for Severance: Meaning that codefendants may wish to have separate trials due to one or more defendants having different sets of charges and this in turn away implications of prejudice. 3. Motion to Determine Competency: Basically a motion to determine whether or not the defendant was mentally stable at the time of the crime. The reasons for these procedures in a criminal trial are so that the defendant(s) are able to receive a fair trial in order to avoid prejudice due to other defendants, multiple crimes, or mental status at the time of the crime. The roles of major participants in a criminal trial are the defense, prosecution, jury, and judge.
