knew David would run out of money and fail. Herman Golelitz has the right to cut off ties with David Klien since he is the one who is making and producing the goods. However there are guidelines and laws that must be followed. To threaten David with ending their partnership and then going to change the name of the brand and still use his recipe to continue to make the same jellybeans is against the federal law. Laws are there so they may be followed and if one does not it is only appropriate to do an investigationand take to court (Jelly Belly Letters , 2012) wrote a letter to the Jelly Belly Company stating they have been under investigation after enough evidence was found of them threatening competitors. They have also threatened distributors telling them to stop selling the “David’s Signature Beyond Gourmet Jelly Beans” or they would stop selling their product of Jelly Belly’s to those distributors. Jelly Belly Company apparently has a contract stating their distributors cannot sell any other jellybeans, which is actually a government violation. This type of principlesmay have been hidden from the public but it takes just the right people to do an investigation on their illegal practices.Jelly Belly Company one of the few of other companies was sent a notice of violation of the California Safe Drinking Water and Toxic Enforcement Act on February 3, 2014. There was evidence found on the use of lead and lead compounds in licorice-flavored candy. The description of exposure states the products are made with ingredients that contain Lead the main ingredient being molasses and other such as licorice flavoring, licorice extract and licorice root
(Somers, 2012). If Jelly Belly Company is willing to violate laws behind doors it can tell you what kind of practices and beliefs they prefer to choose. They like to frighten others and bully them just to be the top man at the end of the day. According to Locke a philosopher on the social contract theory’s believes mankind, is a state of perfect complete liberty to conduct one’s life as one best sees fit, free from interference of others but does not mean one is few to do whatever they please (Friend, C., n.d). One should not interfere with another person but there are times where the nature of war becomes noticed. The nature of war occurs when another interferes to dominate someone else. In this case Jelly Belly Company bullying distributors to not work with competitors is an act of war because they’re trying their best to rid of others such as David who are trying to enter the same market of jellybeans. If there is not such big competition to handle the business of Jelly Belly will always be inferior and dominating.
