议的可能性 The mediation is the intervention in a negotiation or a conflict of an acceptable third party who has limited or no authoritative decision-making power, who assists the parties to voluntarily reach a mutually acceptable settlement of the issues in dispute. The mediation process can include some or all of the following six steps: First, the pre-mediation meetings, mediator may speak with the parties to establish background to the issues and explore their views of the dispute. Second is mediator’s opening statement, in order to establish positive tone for the meeting and trust and comfort between the parties. Then, explains the process and the order of events, clarifies the role of the mediation and parties. In this process, answer any questions about the process and reassures uncertain parties about roles of parties and the process. Third, the parties opening statement and each party invited to present a brief outline of their concerns to the mediator. Fourth, summary and agenda setting. Fifth, exploring the issues and negotiation. Finally, agreement and closure. Mediator in order to creates an environment which encourages the Reciprocity, Trust, Power, Information exchange, Outcome. They need to use the effective of mediation skills enhances the likelihood of an acceptable agreement being reached. For example, they have active listening, listening with interest & non-verbal responses, paraphrasing / reflecting back content & feelings skills. However, the mediator also need to control the process, such as getting one side to consider the other side's position by allowing both sides to present their side and confirming understanding. The mediator effective skills will make the processes enable both parties to explain their perspective, vent their feelings, understand each other’s perspective, enhancing likelihood that an acceptable agreement that they will be reached.
