Hostile Work Environment: workplace is permeated w/ discriminatory intimidation,  ridicule, insult so severe that working conditions are abusive to employee ADEA Protects individuals over the age of 40 from workplace discrimination that favors  younger workers Procedures: Plantiff must show discrim. was the reason for adverse employment action Establish a prima facie case: the employee must provide that the discrim. was based on  age bias ADA Requires employers to offer “reasonable accommodation” to employees or applicants w/  a disability who are otherwise qualified for the job they hold/seek  Defines disability as: Physical/mental impairment that limits one or more of major life activities A record of such impairment Reasonable Accommodation Undue hardship; if an employee w/ disability can perform the job w/ reasonable  accommodation, w/o undue hardship of employer, the accommodation must be made ex; wheelchair ramps, flexible hours only FORMER drug users completed/going through rehabilition programs qualify as  “disabled” employers can fire alcoholic if he posses risk Defenses to Employment Discrimination Business Necessity Requires the employer to demonstrate that a job qualification is reasonable necessary  to the legitimate conduct of the employer’s business It’s a defense to disparate impact discrim.  Bona Fide Occupational Qualifiaction (BFOQ) Defense requires an employer to show that a particular skill is necessary for the  performance of a particular job Used in cases of disparate treatment discrim.
