The restaurants defenses are not valid as it is the responsibility of the system to make sure that the environment is safe and that the customers are offered the best services possible. By stating, that the restaurant is not held responsible for insuring its customer is not enough defense as it has failed to maintain quality standards to protect its clients. Moreover, it has been aware of the condition of the roof and it has not taken the required measure to correct the situation. By not correcting this situation, the restaurant is there guilty of the event that led to the falling and injuring of Allan Brandis. The storm is not in control of the restaurant, however, the restaurant is knowledgeable of what takes place when such an event occurs but it has failed to notify the customers in spite of failing to repair the condition of the roof. Therefore, the restaurant is held responsible for this as it is out of negligence that this event has occurred. It would have repaired the condition once it noticed.
