Forum Non Conveniens: o This is an equitable doctrine that allows a court to refrain from hearing and determining a case when the matter may be more properly and fairly heard in another forum. Ex Piper Aircraft Co. v. Reyno , where the court held that no P may not defeat a motion to dismiss for forum non conveniens merely by showing the substantive law of the alternate forum is less advantageous. Factors: Public interest factors Private interest factors “Center of gravity” a. Piper v Reyno plane crash in Scotland; everything there (witnesses, etc) but the manuf of plane in PA. Π wants PA b/c Π -friendly jurisdiction. Ct dismisses says the better forum is in Scotland b/c public/private interest factors indicate necessity
