According to Zapt (2000), nearly 20 years ago there were an estimated 25,000 to 39,000 competency evaluations that were being conducted in the United States annually. That is, between 2% and 8% of all felony defendants are referred for competency evaluations. Anyone who has a mental illness should be evaluated for competency. In the case for competency test some defendants make it harder for others. This happens because some people are able to lie there way through the test. They can manipulate answers, embellish symptoms, and take advantage of the legal system. There are many people who are arrested by police and try to claim amnesia, or act like they do not understand what crime they have just committed.
