An obligation or duty that the promisor already owes when he makes the promise to assume that obligation or duty Ex: I already have a duty and I make a promise to assume that obligation-does the promise to assume duty lack sufficient consideration Lacks sufficient consideration A promise to refrain from committing a crime or a tort I promise that I will not kill you if you pay me 10000 My legal detriment: give up right to murder you(doesn’t work—you never had the legal right to kill someone) A promise by a holder of a public office to perform a duty required by that office In a reward case, a police officer who captures a criminal while on duty, can’t collect the reward because he is already getting paid a salary to capture criminals An act in which the promisor is already under a contractual duty to perform I agree to sell you my house for 100,000 at closing on may 1—bring title to closing and ask for money—that buyer says tough luck, ill pay you 90,000—I can sue him for the remaining 10,000 because of preexisting legal obligation rule where we had a binging contract where you agreed to pay me 100,000 for the house—if either party could get out of the contract, why have one?
