BUSINESS CONTINUITY PLAN 5 2. Ethical Use And Protection Of Sensitive Data Sensitive data for a business is any information that has important economic value or that could harm the business economically if it were to be disclosed [Com3] . Such information includes operational information, employee information, trade secrets, patents and copyright, marketing plans, sales information, potential acquisitions and any other form of proprietary information that the business owns. Tyndall’s sensitive information is mainly its copyrights and trademarks, which it has protected by ensuring that they are all registered. It has published on its website the names of all the trademarks it owns. They include over fifty brand names and logos which it uses exclusively to market itself, as well as the product attributes under trademark. Publishing is important for when anyone would want to challenge the information, because they will find it publicly available on the website showing that they are solely reserved for the company. It protects the company from legal disputes and wasting time sorting out legal issues related to their trademarks having been misused. Tyndall also categorically specifies how their product names may be fairly used by third parties. These third parties must only make reference to Tyndall product names in text form. They stipulate that these references be truthful and not derogative of the company or misleading to the public, so that the company image is protected. The product names must be tailed by a ® or a ™ symbol at least when referenced for the first time in a clause of text. This indicates that the names belong to a business and should be recognized as such. The company uses ® symbols for all its registered trademarks, and ™ for those products pending registration. This informs the public that the names are reserved and keeps it from claiming them. Regarding patents, the group has published the portfolio of all the patents they own on the website. This puts out the information clearly for all interested party to know the nature of
