The court’s decision in the Pahler case was probably correct. It was a difficult topic to learn about and my heart is broken for Elyse’s family but the boys who put their hands on that young lady are to blame. Saying that, the more I learn about how the law works perhaps I could be swayed. This is a new concept to me and feel I could answer this question better with more knowledge of the law and the investigation. According to the Carl Vinson Institute of Government (2004), a tort is a civil wrong or reprehensible act that results in injury or interference with another's person or property and a crime is a reprehensible act identified by the state or federal government as a crime. Artists are protected by the First Amendment and even though in this example, an unthinkable tragedy was committed, the musicians did not perform the act and in my opinion, should not be charged.
