Today, the laws areapplied to both female and male survivors. It may not matter whether the offender isthe same age as, older than, or younger than the survivor. Further, in some states,factors such as age differences between partners, the age of the survivor, and theage of the defendant are considered. Sexual assaults against males may beperpetrated by other men or by women. Most rapes of men are by other men. Insome states, the word "rape" is used only to define forced acts of vaginal sexualintercourse, whereas forced anal intercourse is termed "sodomy." Although manypeople believe that the majority of male rape incidents occur in prisons, researchsuggests that the conditions for male rape are not unique to prison. Rather, all men,regardless of who or where they are, should be regarded as potential victims. Thereare also many reasons male victims do not come forward and report being raped.Perhaps the main reason is the fear that many will perceive them as beinghomosexual. However, male sexual assault has nothing to do with sexual orientationof the attacker or the survivor.Date Rape
Lecture NotesLet's expand a bit more on date rape. Date rape is usually not planned, and drugsand alcohol used by the assailant or the survivor play a factor in about 70 percent ofthe cases. There is a lifetime incidence for women of 13 to 27 percent for beingraped. This percentage of women will experience a rape in their lifetime. If thedefinition expanded to include attempted intercourse as a result of verbal pressureand misuse of authority, women's lifetime incidence would increase significantly. Withdate rape there's often confusion over consent. Usually, verbal consent is not usuallygiven in sexual activity. Instead, nonverbal cues are used, which are imprecise andeasily misinterpreted if not reinforced verbally. Additionally, our sexual scriptsassume ‘yes' unless ‘no' is directly stated. This makes sex fair game until ‘no' isexplicitly stated. A woman must make her boundaries clear verbally, and men needto avoid misinterpreting clues. In 2003, Illinois became the first state to pass a lawexplicitly stating that people have the right to withdraw their consent to sexualactivity at any time. Post-refusal sexual persistence is the pursuit of sexual contactwith a person after he or she has refused an initial advance. There are fourpostrefusal tactics used: sexual arousal, emotional manipulation and deception,exploitation of the intoxicated, and physical force. Nearly 70% of college studentsindicated they had been subjected to at least one postrefusal sexual tactic since theage of 16. Date rapers, or sexually coercive men, tend to share severalcharacteristics compared to noncoercive men. This is known as the date raper profile.
