The case was close to being dismissed based on lack of evidence, before AFMS filed a second amended complaint. This second complaint included details regarding the collusion, which raised greater concerns to other transportation companies. It brought into question whether UPS and Fed-Ex acted together to formulate a joint decision, which would not have been done independently.
