there now needs to be cause You can always fire for cause You still have the right to quit though at any time Case o Employee is told from the very beginning that he will have job stability, through the employee handbook o Can’t discharge person who isn’t meeting your standard First need to try to rehabilitate o To fire, need cause, and need to try to rehabilitate him Handbook says you must first try to rehabilitate if there is cause to discharge, and if that doesn’t work, then you can fire Case o Statute of frauds does not apply o Statute of discharge o Lower court issued summary judgment Upper court said they shouldn’t have done this o Upper court looks at the following Was the guy an employee at will? Yes President tells the guy that they want to keep him – thus, he is no longer an employee at will (change relationship of employer to employee) Next president discharges the guy based on employee at will Can he do this? There are real questions of fact to be answered regarding wrongful of discharge Other question: checks you receive You get one check (from severance) that is for a few months’ salary
