the issuance of the order of restricted residence, and (iii) a delay of 13 hours before putting the applicant on his way to his place of restricted residence. The declaration was refused because Article 43A(2) authorizes a Deputy Minister to assist his Minister. The delays were held to be reasonable under the circumstances. In Ahmad Saidi Md Isa v Timbalan Menteri [2006] 3 MLJ 208 it was held that the court will not act in vain and grant academic declarations if the impugned restriction order had come to an end. In such a situation there was no longer a valid lis before the court for adjudication. In Keng Kien Hock v Timbalan Menteri [2007] 5 MLJ 611 the appellant was arrested on 6 December 2005 under s. 2(1) of the Restricted Residence Act 1933 but the restriction order under s. 2. 2(2) was issued only on 30 December 2005 i.e. 24 days later. It was held that there was no unreasonable delay and declaration was refused. Any one held in pursuance of a sentence imposed by a court may challenge the order by way of appeal (ss. 307 and 358 of the CPC) or by way of revision under s. 323 of the CPC or s. 35 of the Court of Judicature. 124
