stands for serious literary, artistic, political, and scientific value. If a work lacks this, it may be considered obscene. Finally, there must be a prurient interest to the general public to be considered obscene, and it must depict sexual and offensive actions (FCC). The porn industry believes porn should be legal. They and other proponents of pornographic expression argue that pornography is good for you, citing many studies. A scientist in Hawaii did a study on the effects of pornography. During his studies he did not find a key link between pornography and sexual abuse 2

Meiklejohn (Matyszczyk). He also discovered that pornography does not make men think less of women. He did find, however, that an extremely religious person is more likely to commit a sex crime than others after viewing porn (Matyszczyk). Another argument used by pornography proponents is that pornos are movies in which the participants are willing; therefore, the government should have no say in whether porn is legal or illegal. If two people are allowed to fornicate behind closed doors, they should be allowed to tape and sell it for a profit. It is not in the government’s power to decide who can and cannot have intercourse. The porn industry is a ten billion dollar industry(Castles). Even if the government deems porn illegal, their basis would not be content neutral, which is unconstitutional. The government does seek tox balance rights protected by the First Amendment against obscene material, however. The job of the Federal Communications Commissions, or FCC, is to regulate and enforce laws prohibiting obscene material from being broadcasted. The FCC enforces laws and revokes stations’ licenses if the station airs restricted indecent or obscene material. Indecent material has been restricted by the FCC to air only during “Safe Harbor” hours from 10 p.m. to 6 a.m. Safe Harbor hours are in place primarily to keep child audiences from being exposed to mature material. The FCC also wants to show only material that is desired to adults. In the twenty-first century, pornography is considered immoral by many(Legal or Illegal). Feminist groups and Parents Television Council are two organizations that are against pornography and obscene material. 3

Meiklejohn According to many feminist groups, women in pornography are viewed as sex objects that enjoy pain, rape, abuse, and other physical actions (Richards). In pornography, women are shown enjoying certain abusive activities, which give viewers the impression that all women like this. It degrades women and negates efforts to be treated as equals (Richards). Not only is there a negative effect on women, according to these groups, there is also a negative effect on men, opponents say. Studies show that sex and crime offenders watched porn at a younger age and on a daily basis (Richards). Anti- pornography feminists believe that porn causes violence towards women and needs to be banned to keep females equal to males.
