lIBER4 864 FOLIO 0 !J 80 modification or repair ofthe Condominium property shall be the same and fall upon the same persons as the responsibility for the maintenance and repair of the Condominium property concemed. Section 2. Access at Reasonable Times. For the purpose of performing any of the repairs or maintenance required or authorized by these Bylaws (either by the Councilor a Unit Owner) or for the pUl}Jose of inspecting alterations made pursuant to Article IX ofthese Bylaws or in the event of a bona fide emergency involving illness or potential danger to life or damage to propelty, the Council, through its duly anthorized agents or employees, shall have the right, after reasonable notice under the circumstances to the Unit Owner, to enter any Condominium unit at any hour considered to be reasonable under the circumstances, except that in cases of emergency, no notice need be given to the Unit Owner. Such action will be perfOlmed as a common expense unless the Conncil is performing an obligation of a Unit Owner in which case the expense will be specially assessed against such Unit Owner. Section 3. Limitation of Liability. The Council shall not be liable for any failure of water supply or other services to be obtained by the Councilor paid for out ofthe common expense funds, or for injnry or damage to person or property caused by the elements or from any pipe, drain, conduit, appliance, or eqnipment. The Council shall not be liable to the Unit Owner of any Condomininm unit for loss or damage, by theft or otherwise, of articles which may be stored upon any of the common elements. Article XI Use Restrictions and Rule Making Section 1. Authority. The Condominium shall be used only for those uses and pUl}Joses set out in the Declaration. The Board of Directors shall have the authority to make and enforce reasonable JUles and regulations goveming the conduct, use, and enjoyment of units and the common elements in accordance with the procedures outlined in Section 11-111 of the Act, as it may be amended. Section 2. Prohibited Uses and Nuisances. Prohibited uses and nuisances are specifically set forth in Section 8 of the Declaration and are herein incOl}Jorated in their entirety. The Board of Directors has the right to implement JUles and regulations as it deems appropriate covering different or additional uses/activities that are inappropriate for the Condominium. Section 3. Enforcement. For violations of any duty imposed under tills Article conceming JUles and regulations, duly adopted hereunder, the Board or its designated conunittee shall have the power to enforce the Declaration, these Bylaws and the Rules and Regulations as follows: 31
