problematic. Here are some things I learned about patient confidentiality. It is the patients right to keep information confidential and if the patient does not want to disclose information it is unethical for the physician to do so. If the doctor feels that there is a need to break the patient confidentiality he will need to get written approval from the patient before releasing any information. [5] On another note the HIPAA rules should not be read to create barriers to normal communication with a patient's family or friends. The rules permit doctors or other health care practitioners to share information that is directly relevant to the involvement of a spouse, family members, friends, or other person identified by a patient. If the patient is able to make their own medical decisions it will be up to them if the doctor care share any information with them. It is however, not ethical for the doctor to give any friends or family any information without the patients consent or knowledge. In some situations the physician may be required by law to disclose certain information, and this is usually because the condition may present a danger to others. Another situation wher e a doctor may need to break patient confidentiality is when they notice medical signs of child, adult, or elder mistreatment (elder abuse) or neglect. In these situations they are required to report this information to protective services. Some other conditions that need to be reported are those that seriously impair a person's ability to drive, such as dementia or recent seizures. In these cases they must be reported to the Department of Motor Vehicles.
