Generally, the language of the Fourth Amendment reveals a specific concern for the privacy of “PERSONS” in their “HOUSES.” There is no discussion of the private workplace. Since when did a place of business become “a man‛s castle?” More fundamentally, is a business a “PERSON” within the meaning of the Fourth Amendment? I use my work pc to do my homework on a regular basis. If someone is using a work tool to conduct personal business, then I feel that, with justification, a person may give up their right to privacy as well as the company's right to privacy because they are using business tools or space for personal use. This is a risk that businesses take when employing others and giving them use of space and tools. It protects individuals (US ci⏌?zens) from state ac⏌?on which is in this case the government. The workplace is not a person’s castle but his personal papers and effects are his belongings and the search of these items is protected by the 4 th Amendment. The 4th amendment seems to be very tricky in how it actually protect you. I'm on the phone more than 4 hours a day at my job answering calls and taking lead to help my organization grow. As an employee, I think it's interesting how organizations are held accountable for employee behavior as it relates to criminal law. I couldn't imagine an employee sitting next to me having their business computers taken away by a higher authority due to possible criminal deviancy. Great post and i look forward to reading more
