Is this also a sex-plus case? Why or why not? Sex-plus discrimination refers to situations where an employer classifies employees on the basis of sex plus another characteristics. The employer does not discriminate against all women or men as a whole but rather the employer treats a subclass of women or men differently. I believe that this is a sex-plus case because Cullinan did not like the way Lewis look. She was not feminine enough or pretty enough for Cullinan 4. In a dissenting opinion, one of the judges who heard this case wrote that “[a]pparently,, the majority would hold that an employer violates Title VII if it declines it hire a female cheerleader because she is not pretty enough, or a male fashion model because he is not handsome enough...” Do you agree? Was this case correctly decided? Why or why not? The case was correctly decided. The dissenting opinion of the judge that, “apparently, the majority would hold that an employer violates Title VII if it declines to hire a female cheerleader because she is not pretty enough, or a male fashion model because he is not handsome enough” is valid because it is an employer’s decision to hire or fire based on a person’s physical appearance is not discrimination if it is line with the other norms of hiring and firing. When the employer follows all rules while hiring and firing of employees, it doesn’t violate Title VII. In the case of Lewis, it was pretextual firing as Lewis lacked Midwestern girl look. Cullinan’s requirements that Lewis be “pretty” and have the “Midwestern girl look” were because she is a woman cannot be considered as it was not mentioned in writing. Moreover, other employees did not appear for the second interview but Lewis was forced to do so. In this case Lewis side is justified. 5. What, if any, appearance policy would you recommend for a hotel? Dress, grooming, and personal cleanliness standards contribute to the morale of all employees and affect the business image company presents to customers and visitors. During business hours or when representing the company, you are expected to present a clean, neat, and tasteful appearance. You should make sure your hair is clean and neat. Your clothes should be clean and neat. Your should have no poor personal hygenie.
