o Good Faith Provision = requires parties to make a sincere effort to reach an agreement Strike o The NLRA gives the right to strike o Available when collective bargaining has reached an impass o Must be brough on by majority of employees not a minority (wildcat strike) Nonunion employees o Have right to walk out with strikers but employers have a “free hand” when dealing with them Title VII, Civil Rights Act of 1964 (Private Companies) o Prohibits workplace discrimination against race, color, religion, sex, or national origin o Doesn’t cover sexual preference o Religious organizations may discriminate based on religion Coverage o Has 15 or more employees o Affects interstate commerce Scope of Protection o Protects all previously state groups o It is not illegal for employers to require employees to be US citizens o Protects women that are pregnant as well Procedures and Remedies o Anyone who feels discrimination may take employer to court o Equal Employment Opportunity Commission = receives complaints of violations, attempts to reconcile employer and employee but if failed the commission may file a suit in a federal district court Intentioanl Discrimination – Disparate Treatment o An employer intended to discrimate for a prohibited reason, sunstamtial contributing factor This can be proved in several ways: Explicit Exlcusionary Policy = if a company has a policy excluding those of a particular group, there is no question of intentional discrimination 13

Evidence of Intentional Discrimination = even if there is not explicit evidence of intentional discrimination, there is evidence of devicions blown out of proportion because of perons group o Firing a man over stop sign because he is male Circumstantial Evidence = evidence is not clear cut, but inference that there was underlying discriminatory motivation from an aggregation of circumstantial evidence Prima Facie Case o Suit against employers’ discriminatory actions, has to prove conditions before you can even go to court o Elements: The applicant is within protected class
