Ordinance or Law When a building that does not conform to current building codes is severely damaged, regulations often require that is may be rebuilt only if it is made to conform to current requirements o Demolition of undamaged portions o Costs to update to code 2. Earth Movement Earth movement includes” earthquakes, landslides, mine subsidence, etc. **Fire/explosion still covered If a fire happens from an earthquake, that is covered, but damage from earthquake is not 3. Governmental Action Seizure or destruction by governmental authority Unless to protect against spread of fire 4. Nuclear Hazard (NH) Fire caused by NH covered 6. Utility Services Expierence a loss because of a loss of power or electricity and that occurred off your premises – your power plant expierenced some issue and because of that they can’t provide you with electricity and now because of that everything in your fridge rots, not covered 7. 8. Water Includes: flood, mudslide, water backup from sewers and drains Damages from naturally occurring water 9. Fungus, Wet Rot, Dry Rot, and Bacteria o Additional Exclusions o Basic & Broad Form These four exclusions do NOT contain anti-concurrent causation language Artificially generated electrical current Explosion of steam boilers o Exclusion does not apply if the steam boiler is not owned or leased by the insured and is not under the insured’s control (think tenant) Mechanical breakdown Neglect o Use reasonable means to save / preserve property after loss o Special “All-Risk” Form Covers any accidental cause of loss unless the policy specifically excludes it Advantages Shifts burden of proof from insured to insurer Provides slightly broader coverage for perils like theft, friendly fire, and damage caused by vehicles owned by the named insured / operated by the name insured in the course of business Because you don’t know exactly what will happen, this form provides more protection o Special “All Risk” Exclusions Maintenance Exclusion Eliminated coverage for losses typically preventable through maintenance or expected through the passage of time o Includes (but not limited to) o Wear & tear 24
