The EU Agenda on Anti- Discrimination and Diversity: Directives and their Implementation Interdisciplinary research team: Maritta Soininen , Paulina de los Reyes and Ph.D. fellow in the sociology of law to be recruited The focus of this project is on the interplay between introduction of comprehensive anti- discrimination legislation and the norms informing its implementation, with emphasis on the role of the social partners. The results of the earlier comparative research on diversity and anti- discrimination policies clearly indicate some difficulties in adopting the EU anti-discrimination directives in the national legislation in the EU members states. They also reveal long-term institutional changes in balance of power between the authorities, labour market partners, and NGOs, as the EU legislation has a strong emphasis on the empowerment of local and non-governmental actors. The transnational cross- border policy development plays an important role for the changing policymaking conditions (Soininen 2003; Soininen 2006). A number of intricate questions remain to be solved after the first phase of incorporating the anti- discrimination directives in member state legislation. The European Employment Strategy (EES) together with the Community anti- discrimination legislation (EC 2000/43; EC 2000/78) which are in particular designed to promote ‘conditions for a socially inclusive labor market’ and high levels of employment, embody a shift towards a participatory democratic and deliberative policy process. The project studies effects of the enforcement of EU anti- discrimination legislation in Sweden. Sweden is a ‘critical case’ given the central role of social partners in public policy formulation and implementation, and a long tradition of deliberative policy making. How do central actors in public discourse, including the social partners, articulate the problem of discrimination? How do they conceptualise the process of law enforce- ment in labour market and working life issues? The project will, given a market gate-keeper role for the unions in Swedish legislation, include a detailed case study focus- ing on ethnic and gender inequality and the formulation and implementation of union strategies intended to cope with racism and sexism. The empirical analysis of the implementation of the legislation, based on interviews and document analysis, will contribute to new knowledge on factors for actual enforcement of anti-discrimination legislation. In a theoretical perspective the empirical studies will contribute to highlight some of the crucial questions concerning the effectiveness – both as regards democratic values
