The contractor will not receive the incentive payment if you determine that exceeding the goal was not due to the contractor's efforts, such as a subcontractor cost overrun or an award of subcontracts planned but not disclosed in the subcontracting plan during contract negotiations. These determinations are not subject to the Disputes Clause at FAR 52.233-1. h. SDB Incentives i. Each year the Department of Commerce (DOC) determines if there is a persistent and significant underutilization of minority firms within particular industries due to past or present discrimination. ii. If the DOC determines that discrimination exists/has existed, then additional incentives are available to stimulate economic development within those groups and areas.
