Acts punishable by… that is if there is mistreatment of the children if at all we legalisethe child workers issue.Another issue is in the event of marriage, women are made to adopt the name of thehusband. I have seen in some cases whereby some women do not receive their houseallowance just because they bear the names of their husbands and you find that thehusbands are receiving the house allowances instead of them. So we need to look intothat also. Then in the event of marriage again, all the property owned by the man becomes propertyof the two people who acquire the new status of husband and wife. On the other hand, ifthe wife owned any property prior to the marriage, she is left to own the propertyprivately. I feel that should also be looked into. The role of the media. Looking at the media presently, and especially on the issue ofadvertisements, I think it is a high time that we came up with some rules guarding thekind of advertisements we get in the market. I would point out the specific controversialone of the ‘Trust Condom’. That is all, thank you.Com. Adagala: Thank you for that Wairimu. There are many things that need to be dealtwith; you know the law does not ask women to change their names. It has just become atradition from Western Europe, but the law here does not require of that. So, women do itout of habit more than anything else, they need not do it. But also I felt that you neededto probably be a little bit clear on the matrimonial property, I think that is what you weretalking about isn’t it? You need to look at it again when we give you the questions andissues. You look at it again and see what you what to be done. I don’t want to tell youwhat should be done because we are a different generation, if nothing else and if you area different generation you need to see. You are saying something which might be useful.Okay, lastly.Page 25 of 29Last printed 21/01/2003 04:48:00 PM

Masika David: Just to add something… I am Masika David. The Office of thePresident. I think the Constitution should provide room for impeachment of thepresident. In case of any criminal acts committed by the president, a tribunal should beappointed by parliament. If the president is found guilty, then an impeachment procedureshould be carried out.On the Police Commissioner again, the Police Commissioner should be subject toparliament. In that, in case of any insecurity in any part of the nation, the PoliceCommissioner should be summoned to appear before parliament. I think the Constitutionshould provide for that. Again, the Police Commissioner should be answerable in casethere are arrests made without an arresting warrant or a Police Officer should submit hisService Number in case he wants to arrest somebody. Because we have been havingcases whereby people are arrested but when it comes to tracing them, their relatives findit impossible because you don’t know who arrested them, whether it was a police or not.
