Basing on the information presented in the article and the Texas Penal Code laws, I believe that the old man sexually abused a young child who is defined as a girl under sexual consent age. In my opinion, I would recommend harsher punishments for this man. As far as statutory rape is a strict liability offense, I would suggest life imprisonment. Sharing sexual images with the minor is an offense on its own while having sex with the minor in more than one occasion is worse.

He posted on Facebook that he is going to kill, sell his home to fund more conservatives who will help him kill the liberals. Investigations at Patrick’s home uncovered a number of deadly weapons. Patrick is currently being held on a $ 500000 bond in Florida. Under Texas Laws, James Patrick could probably be charged with assault listed in Title 5 (Offense against persons). Chapter 22 (Assaultive Offenses) of Texas Penal Code, section 22. 01 (assault), a (2) “ A person commits an offense if the person intentionally or knowingly threatens another with imminent bodily injury, including the person's spouse”. a (5) an offense under this section is a third degree felony. Under Texas penal Laws, an individual guilty of a felony in the third degree should be punished by serving for any period not less than two years and not more than 10 years in jail or a fine not exceeding $10,000. Patrick’s threat over social media must have caused intense fear of harm to all the members of the congress. However, the prosecution needs to prove mens rea element before accusing the defendant guilty. Planning to fund other conservatives to help him in commission of the offense should be termed as a terroristic threat. In my opinion, he should therefore be punished for assault and terroristic threat as per Section 22.07 a (1)” a person commits an offense (terroristic threat) if he threatens to commit an offense involving violence to any person or property with intent to: (2) place any person in fear of imminent serious bodily injury, (5) place the public or a substantial group of the public in fear of serious bodily injury”. Therefore, I would suggest 10 year-imprisonment with a fine of $ 5,000.
