Conclusion In a nutshell, a contract is a valid and legally binding agreement that entered into two or more competent parties. A contract can also be defined as a legally binding exchange of promises between two or more parties that the law will enforce. Under Section 2(h), a contract can be defined as an agreement enforceable by law. That means an agreement should contain all the legal necessities to form a valid contract. Therefore, an agreement can be enforceable by law. An agreement which cannot be enforceable by law is treated as void contract. An agreement enforceable by law is contract, and by such a contract only relations between the parties occur. An agreement is a form of cross reference between different parties, which may be in written, verbal and lies upon the honour of the parties for its fulfilment but not being in anyway enforceable. A contract therefore, is an agreement the object of which is to create a legal obligation, for example, a duty enforceable by law. Therefore, we found that a contract essentially involves two elements, which are an agreement and legal obligation, for instance, a duty enforceable by law. That means every contract enforceable by law comprise an agreement. But every agreement may not form a valid contract and may not be enforceable by law, if it does not contain all the requirement of the essential element of a valid contract. Therefore, there are all contracts are agreements but not all agreements are contracts. Differences between contract and agreement The one of the difference between contract and agreement is contract is comes out from an agreement while agreement is come out from the consent of the parties. Furthermore, contract is always enforceable and legal while agreement may be moral and may not be enforceable. Besides that, a contract comprises an agreement while an agreement does not comprise a contract. The scope of a contract is narrow this is because it comprises commercial agreements only. On the other hand, the scope of an agreement is relatively broader due to it comprises social agreements and commercial agreements. Only legal agreement can be treated as contract while an agreement may be both legal and illegal. Contract must contain a legal obligation. Unlike contract, it is not necessary for agreement to contain legal obligation. 8
