The four steps in proving negligence are:
- Duty: While assessing the negligence, it is important to assess
whether or not the person accused of negligence has a
responsibility to provide a care to him or not.
- Breach of duty: Next step is proving whether or not the accused
person did the wrong thing or neglected the person even though he
knew the situation.
- Causation: It is also important to make sure that it was the action of
the accused person that led to the client’s harm and that he was
fully aware of the consequences of his negligence act.
- Damages: This process includes that the accused person is able to
pay the client in monetary form for the damages he did.
