practice law in this jurisdiction. (c) A lawyer admitted in another US jurisdiction, and not disbarred or suspended from practice in any jurisdiction, may provide legal services on a temporary basis in this jurisdiction that: (1) are undertaken in association with a lawyer who is admitted to practice in this jurisdiction and who actively participates in the matter; (2) are in or reasonably related to a pending or potential proceeding before a tribunal in this or another jurisdiction, if the lawyer, or a person the lawyer is assisting, is authorized by law or order to appear in such proceeding or reasonably expects to be so authorized; (3) are in or reasonably related to pending or potential arbitration, mediation, or other alternative dispute resolution proceeding in this or another jurisdiction, if the services arise out of or are reasonably related to the lawyer’s practice in a jurisdiction in which the lawyer is admitted to practice and are no services for which the forum requires pro hac vice admission; or (4) are not within paragraphs (c)(2) or (c)(3) and arise out of or are reasonably related to the lawyers’ practice in a jurisdiction in which the lawyer is admitted to practice. practice in any jurisdiction, may provide legal services in this jurisdiction that: (1) are provided to the lawyer’s employer or its organizational affiliates and are not services for which the forum requires pro hac vice admission; or (2) are services that the lawyer is authorized to provide by federal law or other law of this jurisdiction. Books written by lay advisors are not generally deemed the unauthorized practice of law, but when the author begins to give actual legal advice, UPL has been found. The Practice of Law is defined in Arizona Land Title and Trust as: providing legal advice or services for another by (1) Preparing any document in any medium intended to affect or secure legal rights for a specific person or entity; (2) Preparing or expressing legal opinions; (3) Representing another in a judicial, quasi-judicial or administrative proceeding or other formal dispute resolution process such as arbitrations and mediations; (4) Preparing any document through any medium for filing in any court, administrative agency or tribunal for a specific person or entity or (5) Negotiating legal rights or responsibilities for a specific person or entity. Appearing in court other than pro se is clearly the practice of law. The Unauthorized Practice of Law is defined as: (1) Engaging in the practice of law by persons or entities not authorized to practice law OR (2) Using designations, the use of which is reasonably likely to induce others to believe that the person or entity is authorized to engage in the practice of law in the state.
