(2) Other responsible causes, including the conduct of the plaintiff and third persons, are sufficiently eliminated
by the evidence AND
(3) The indicated negligence is within the scope of the defendant’s duty to the plaintiff (if you don’t have duty
it doesn’t matter if you can’t breach)
Restatement (Third)
Adds to second that the negligence can be inferred when the accident causing harm is a type that “ordinarily
happens because of the negligence of the class of actors of which the defendant is the relevant member”
Big difference in the three is how the 2 nd prong of the common law approach (control) has evolved over time:
 At common law, control rule taken very literally—court rejected res ipsa when someone sat down on a
chair in a department store because the chair, at the time she sat, was in her exclusive control
 More modern view is that control is only one way of establishing that negligence was probably that of
the defendant, not that of someone else.
From Byrne v. Boadle – policy reasons for res ipsa - administration, we want to allow those who have been
harmed to present their cases in court, and in a situation like this, it wouldn’t be fair to require plaintiff to
produce the evidence.  When there is an asymmetry of knowledge (defendant only one that would have
evidence as to any negligence), we don’t want to penalize plaintiff (injured party)
Res ipsa loquitur evidence is different from circumstantial evidence because circumstantial evidence is meant to
support an inference of a fact that can go into the evaluation of the reasonable person circumstance.  Res ipsa
loquitur evidence is meant to support an inference that the reasonable person standard was violated.
Presumption effect:
 Res ipsa creates a presumption of negligence
 Thus, burden shifts to defendant to prove he was not negligent
 This is a minority rule
Directed verdict question – can a reasonable juror find in favor on behalf of the non-moving party?  If yes, no
directed verdict (goes to jury); if no, directed verdict in favor of moving party
Exploding Bottle Cases:
Courts originally did not allow you to invoke res ipsa – that has changed
 Plaintiff can use res ipsa by showing that the defendant
o Had control at the time of the probable negligence
 This could be shown by excluding the negligence of others

Causation:
Defendant’s breach caused damage
Cannot answer causation without determining if (1) D owed P a duty (2) D breached that duty, and (3) injury to
P occurred as a result to the breach – causation asks if the breach was the cause of the injury

a. But-for the defendant’s negligence, the plaintiff would not have experienced the particular injury
b. Not necessary that the defendant’s act by the sole cause of the injury, only must be a cause
