Module 2 v2.8R Provision and Clause Applicability Exercise Instructions: Read the scenario below about a DoD acquisition and answer the corresponding question. Provide a citation to the exact reference in the FAR, DFARS, DFARS PGI, or CD where the information supporting your answer can be found. FAR, DFARS, and DFARS PGI citations must comply with the format requirements at FAR 1.105-2(c) and take the reader directly to the information supporting your answer. Do not cite anything in FAR subpart 52.2 or DFARS subpart 252.2. Scenario: You have received a requirement for 10 noncommercial shark-mounted laser weapon systems that is expected to cost $1,500,000. The items must be delivered to Guam. The acquisition will be conducted full and open competition (i.e., it will not be set aside for small business), and subcontracting possibilities exist. You intend to use negotiated contracting procedures and award a cost-plus-incentive-fee contract without conducting discussions. The Government is willing to accept alternate proposals. Due to budget constraints, the contract will be incrementally funded. The DoD requires form, fit, and function data rights. None of the exceptions at FAR 27.409(b)(1) apply. There will be no Government property provided, and this acquisition is not in support of a declared contingency operation. The solicitation contains all provisions and clauses required by the FAR and DFARS, except for those shown below. Question: Which of the provisions or clauses listed below should be included in the solicitation? Note: Remember that when an alternate applies, the basic version is incorporated automatically but is modified by the alternate(s) that may apply. Therefore, you would only indicate “Yes” in front of the version with the appropriate alternate(s) – and indicate “No” for the remaining versions, including the basic version of the provision or clause because it has been altered.
