3. The second plaintiff is and was at all material times the managing director of the first plaintiff. 4. The first plaintiff is the proponent of a nuclear waste disposal facility to be located at the site and is and was at all material times engaged in preparatory excavation work at the site to prepare it for that purpose. 5. On 12 January 2009 at or around 8:00am the defendant entered the site without the consent of the plaintiffs and affixed herself by means of a chain and lock to a gate at the site. 6. On the same date, the defendant displayed a sign styled “No Nuclear Waste Dump”, which was affixed to a gate at the site. 7. On the evening of 12 January 2009, sound and images of the defendant were broadcast on ABC television news. Particulars (a) The defendant was filmed chained to a gate at the site with a banner reading “No Nuclear Waste Dump” visible. (b) The defendant spoke the following words (‘the Words’): “The nuclear waste dump that is being planned for this site will be an environmental catastrophe for generations. The company proposing the dump are eco-criminals who have to be stopped.” 8. In speaking the words in the particulars to paragraph 7, the defendant knew, or alternatively, ought to have known, that the words would be republished on television news and broadcast to a wide audience in Victoria.
