NO
PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. MAKING A PURCHASE DOES NOT
INCREASE YOUR CHANCES OF WINNING. The Course Hero, Inc. Veteran Scholarship
(the “Contest”) is sponsored by Course Hero, Inc., having an address of 2000
Seaport Blvd. Third Floor, Redwood City, CA 94063 (“Course Hero”).
ELIGIBILITY:
Subject
to these Official Rules, the Contest is open only to permanent legal U.S.
residents physically residing in the fifty (50) United States of America and
the District of Columbia, who: (i) are retired, honorably discharged or active
duty service members of any branch of the United States military, including the
United States Army and Reserves, United States Navy and Reserves, United States
Air Force and Reserves, United States Marine Corps and Reserves, United States
Coast Guard and Reserves, the National Guard and Air National Guard, or
spouses, children or family members of such service members; (ii) are at least
16 years old as of the date of entry; (iii) are currently enrolled full-time or
part-time in a two-year or four-year accredited undergraduate or graduate
college or university, or vocational, technical or private career institution
in the United States, as listed on the U.S. Department of Education website,
available at https://ope.ed.gov/dapip/#/home; (iv) have a minimum GPA of at
least 3.0 on a 4.0 scale (or equivalent); and (v) are registered Course Hero
users who have submitted an entry at https://www.coursehero.com/scholarships/
by submitting a written response to the Contest question. The response must be
limited to 500 words or less. Minors between the ages of 16 and 17 (inclusive)
must first obtain the consent of their parent or legal guardian to enter. Scholarship awards will not be paid to
institutions outside the U.S. Employees of Course Hero and their respective
parents, affiliates, subsidiaries, and advertising and promotion agencies and
any other entity involved in the development or administration of this Contest,
and their immediate family members or household members are not eligible to
participate in or win the Contest. THE CONTEST IS VOID WHERE PROHIBITED OR
RESTRICTED BY LAW OR WHERE BONDING, REGISTRATION, OR OTHER REQUIREMENTS WOULD
BE REQUIRED BUT HAVE NOT BEEN MET, OR WHERE THE METHODS OF ENTRY SET FORTH
BELOW WOULD BE DEEMED CONSIDERATION. ALL APPLICABLE FEDERAL, STATE AND LOCAL
LAWS APPLY.
CONTEST
OVERVIEW:
Course
Hero will post one question online at https://www.coursehero.com/scholarships/
and allow registered, eligible entrants up to 500 words to submit a written
response. Course Hero will select one winner with the best response from among
all Contest entrants. The Contest winner
will receive a $5,000 (USD) scholarship (the “Scholarship”).
ENTRY
PERIOD:
The
Contest will begin at 12:01 am PST on January 21st, 2020 and will end at 11:59
pm PST on July 3rd, 2020 (“Entry Period”). The deadline to submit entries for
the Contest will be displayed on the Contest entry page. Once the Entry Period
has passed, no further entries for the Contest will be accepted. Course Hero
will announce the winner on social media and/or its website by August 3rd,
2020. Course Hero reserves the right to change any beginning or end dates of
the Contest at any time. Course Hero also reserves the right to discontinue the
Contest at any time.
HOW
TO ENTER:
No
purchase or payment is necessary to participate in the Contest. Participants
must agree to Course Hero’s Terms of Use
(https://www.coursehero.com/terms-of-use/) and Privacy Policy
(https://www.coursehero.com/privacy-policy/), and register for an account on
CourseHero.com. During the Entry Period,
enter the Contest by visiting https://www.coursehero.com/scholarships/, logging
in to your Couse Hero account and submitting a written response to the Contest
question. The response must be limited to 500 words or less. Alternatively,
Contest entries may be submitted by mail by printing your name, address, and
daytime phone number on a 3”x5” card, along with your response to the question,
and mailing it to Course Hero, Inc., 2000 Seaport Blvd. Third Floor, Redwood
City, CA 94063. Multiple entrants that submit the same response will be
disqualified. Any late, lost,
misdirected, incorrect or incomplete entries will be disqualified and Course
Hero and its agents will not be responsible for such entries.
By
submitting an entry, you agree that any information provided by you or
collected by Course Hero in connection with the Sweepstakes may be used by
Course Hero in accordance with Course Hero’s Terms of Use
(https://www.coursehero.com/terms-of-use/) and Privacy Policy
(https://www.coursehero.com/privacy-policy/) and may be shared with Course
Hero’s affiliated business entities. All information submitted to Course Hero
as part of an entry becomes the property of the Course Hero.
Course
Hero expressly reserves the right to disqualify any entries that it believes in
good faith are generated by an automated means or scripts, or that are the
result of plagiary. Entries generated by script, macro or other automated means
are void. By entering, you agree to accept and be bound by all terms and
conditions in these Official Rules.
SELECTION
OF WINNERS:
One
or more judges from Course Hero shall read each of the eligible Contest entries
and select a winning response. The Judge(s) shall base their decision on the
following criteria: sincerity, creativity, thoughtfulness, and factual
credibility. Odds of winning depend on the number of entries and the quality of
your response as evaluated by the Course Hero Judge(s). The Contest will be
conducted under the supervision of Course Hero. The decisions of Course Hero
are final and binding in all matters relating to this Contest.
To
receive a complete list of winners or a copy of the Official Rules, within six
(6) months after the end of the Entry Period, send a self-addressed stamped
envelope to Course Hero, Inc., 2000 Seaport Blvd. Third Floor, Redwood City, CA
94063, Attn: “Course Hero, Inc. Veteran Scholarship Contest Winner’s List” and
specify the month(s) for which you wish to receive such information.
SCHOLARSHIPS:
The
Contest winner will receive a $5,000 Scholarship to be applied toward tuition
at the college or university in which they are enrolled. In no event shall
Course Hero be obligated to award any prizes other than the Scholarship
specified in these Official Rules. The Scholarships are non-transferable and no
substitutions (including, without limitation, for cash) are permitted. The
winner shall be solely responsible and liable for all federal, state and local
taxes, and any other costs and expenses, associated with the Scholarships.
CLAIMING
YOUR SCHOLARSHIP:
The
Contest winner will be notified by email and/or phone; provided, however, that
Course Hero reserves the right to determine an alternate method of
notification. Failure to provide
accurate contact information may result in disqualification, and if unable to
contact the winner within 72 hours, Course Hero may in its discretion award a
Scholarship to any other eligible contestant.
Scholarships
will be awarded to the winner and paid directly to their accredited college,
university or institution for tuition for the semester following their win. The
winner is required to provide Course Hero with the following information if
requested:
Your
Course Hero username and profile URL;
Your
residential address and phone number;
Your
student identification card at your enrolled college or university;
Your
current or most recent transcript from your enrolled college or university;
Contact
and mailing information for your college’s or university’s financial aid
office;
No
payment of any Scholarship will be granted until Course Hero is able to verify
with the winner's financial aid department that you are enrolled at the
institution. The winner must cooperate with Course Hero and their institution
in filing or providing any necessary paperwork or other materials or signatures
deemed necessary by Course Hero or the institution in their discretion to
process the Scholarship. Any Scholarship won by an eligible minor will be
awarded in the name of a parent or legal guardian. Course Hero may, in its sole
discretion, decline to award payment of the Scholarship in the case of a
winner's failure to provide information in a timely fashion requested by Course
Hero or the institution, or if the student's enrollment lapses for any reason.
PAYMENT
DIRECTIONS:
Course
Hero will pay the Scholarship directly to the U.S. accredited college or
university of the eligible winner in one lump sum. No Scholarship moneys will
be paid directly to the winner. Course Hero has the sole discretion and final
word over the timing and manner of any scholarship payments. The winner will be
responsible for providing a letter of enrollment from the college or university
where the Scholarship will be directed.
GENERAL
CONDITIONS AND RELEASES:
By
entering the Contest or accepting a Scholarship, you agree to conform to all
federal, state and local laws and regulations. When applicable, the winner may
be required to execute and return (and winning may be conditioned upon the
winner executing and returning) to Course Hero, within ten (10) business days,
an Affidavit of Eligibility and a Liability and Publicity Release drafted by
Course Hero to be eligible for the Scholarship or an alternate winner will be
selected. The winner may be required in Course Hero’s sole discretion to
complete relevant tax forms as a condition to the delivery of the Scholarship.
The winner may also be required to furnish proof of identity, address and birth
date in order to receive a Scholarship.
Unless
prohibited by applicable law, your submission of an entry to the Contest or
acceptance of a Scholarship constitutes your permission to use your name,
photograph, likeness, voice, address (city and state), testimonials, and any
other information provided to Course Hero in connection with the Contest in all
media, in perpetuity, in any manner Course Hero deems appropriate for publicity
purposes without any compensation to such entrant or any review or approval
rights, notifications, or permissions; and constitutes your consent to disclose
your personally identifiable information to third parties (including, without
limitation, placing the winner’s name on a winner’s list).
An
entrant or winner may be disqualified from the Contest if he or she fails to
comply with each provision of these Official Rules, as determined in the sole
discretion of Course Hero. Participation in the Contest is at entrant’s own
risk. Course Hero shall not be liable for: (1) failed, returned or misdirected
notifications based on inaccurate information provided by the winner in
connection with an entry; (2) entries and responses to winner notifications
which are lost, late, incomplete, illegible, unintelligible, postage-due,
misdirected, damaged or otherwise not received by the intended recipient in
whole or in part or for computer or technical error of any kind; (3) any
electronic miscommunications or failures, technical hardware or software
failures of any kind, lost or unavailable network connections, or failed,
incomplete, garbled or delayed computer transmissions which may limit an
entrant's ability to participate in the Contest; (4) any technical malfunctions
of the telephone network, computer on-line system, computer equipment,
software, program malfunctions or other failures, delayed computer transactions
or network connections that are human, mechanical or technical in nature, or
any combination thereof, including any injury or damage to entrant's or any
other person's computer or mobile device related to or resulting from downloading
any application or otherwise in connection with this Contest; or (5) any
warranty with respect to any Scholarship or any component thereof. THE
SCHOLARSHIPS ARE AWARDED “AS IS” AND COURSE HERO DOES NOT MAKE ANY, AND HEREBY
DISCLAIMS ANY AND ALL, REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE
SCHOLARSHIPS.
NOTWITHSTANDING
ANYTHING ELSE HEREIN OR OTHERWISE, COURSE HERO AND/OR ITS VENDORS SHALL NOT BE
LIABLE OR OBLIGATED WITH RESPECT TO ANY SUBJECT MATTER OF THIS AGREEMENT OR
UNDER CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY
FOR (A) ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES
(INCLUDING, WITHOUT LIMITATION, LOSS OF REVENUE, GOODWILL, OR ANTICIPATED
PROFITS), (B) DATA LOSS OR COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES,
AND/OR (C) ANY MATTER BEYOND SUCH PARTIES’ REASONABLE CONTROL.
By
entering the Contest, you agree to and hereby do release and hold harmless
Course Hero and its respective parents, subsidiaries and affiliated entities, directors,
officers, employees, attorneys, agents, and representatives from any damage,
injury, death, loss, claim, action, demand, or other liability (collectively,
“Claims”) that may arise from your acceptance, possession and/or use of any
awarded Scholarship or your participation in this Contest, regardless of
whether such Claims, or knowledge of the facts constituting such Claims, exist
at the time of entry or arise at any time thereafter. Any person attempting to
defraud or in any way tamper with this Contest or with Course Hero’s website
may be prosecuted to the full extent of the law. Course Hero reserves the right
to modify these Official Rules in any way or at any time. Course Hero reserves
the right, in its sole discretion, to cancel or suspend this Contest should
viruses, bugs or other causes beyond their control corrupt the administration,
security or proper operation of the Contest. In the event of cancellation or
suspension, Course Hero shall promptly post a notice on Course Hero’s website
to such effect. This Contest shall be governed by California law, without
regard to conflicts of laws provisions. By participating in this Contest, you
agree that any dispute or litigation arising from or relating to this Contest
shall be determined by binding arbitration only in San Mateo County, CA, by and
under the Streamlined Arbitration Rules and Procedures of JAMS, and judgment on
the award rendered by the arbitrator(s) may be entered in any court having
jurisdiction thereof. Notwithstanding
the foregoing, Course Hero may seek equitable relief in any court of competent
jurisdiction. If any provision of these
rules is held to be illegal or unenforceable, such provision shall be limited
or eliminated to the minimum extent necessary so that these rules otherwise
remain in full force and effect and enforceable.
