Interpretive process. If the precedent is relevant and supportive of case, the lawyer will analogize (argue that the fact in her case are similar to the facts in the prior case that those earlier, supportive decisions should apply to it too). If the case is not supportive, lawyer will attempt to distinguish case from earlier cases by persuading the court of the significant factual and legal differences between them.
